Highway 198 easement acquisition

Payson's City Council held a public hearing at its Oct. 21 meeting on the city's proposal to acquire an easement by eminent domain at 1168 South Highway 198. Eminent domain lets a city take a property interest for a public purpose after paying fair compensation, usually after negotiation has failed or when it is the only way to get the right. The one-page notice, dated Oct. 8, only says the hearing was to take public input. It does not name the property owner, state the public purpose, describe the easement's size or location on the parcel, or give a price. The notice is not a decision to condemn, and the council's action, any offer and any court filing are not in a posted record.
