Finch Creek development agreement

Finch Creek is a development with a master development agreement (MDA) that Heber City reopened this fall over its housing terms. On Sept. 15 the council voted 4-0 (one member absent) to approve an amended MDA conditioned on a final review at its next meeting, after the city attorney warned the changes were large enough to deserve a second look on the consent agenda. The council's changes: carry over the government-employee language from the original MDA for the 60%-of-area-median-income units, require that those units stay deed-restricted at that level whether rented or sold, with rent and HOA fees held there, and add fair-housing and enforcement language. The project's attorney asked for a vote so work could continue. A first amendment returned on the Oct. 6 consent agenda. The recorder's notice of adopted ordinances does not cover consent-agenda items, so whether the final amendment was approved and signed is not confirmed.
