Cedar 106 water credit allocation

When Cedar City annexed the land that is now called Cedar 106 in 2006, as part of the Steve Sevy Annexation, the city required 1.2 acre-feet of water rights for each acre annexed. Some of the land arrived with water ("wet"), some partly wet and some dry. Cedar 106, LLC asked to move that water acquisition credit around among the development's residential parcels, and after several years of back-and-forth the city attorney and staff brought an agreement to the council's Oct. 21 work meeting. It reallocates 81.565 acre-feet within the development agreement area, for example 8.41 acre-feet to one R-1 parcel and 23.38 to an R-3-M parcel, and nothing to three commercial parcels. It does not create new water supply. The attorney's memo says he generally opposes moving credit between properties because it is hard to track and could create a market in cheap credits, but he supports this agreement because it stays inside one development-agreement area. The credits would run with the land, and the developer would give up contract claims against the city. The packet copy is unsigned and undated; no approval is recorded yet.
