So Jo Marketplace Public Infrastructure District: creation and governing document

Approved · 3-2 · South Jordan Parkway, east of Mountain View Corridor

Assistant City Manager Don Tingey presented the resolution, which creates a public infrastructure district for a 17-acre retail and commercial development on South Jordan Parkway, east of Mountain View Corridor. The council held a public hearing on May 5, 2026, then postponed action to review a State Auditor alert and state-law changes that took effect May 6. Staff said the resolution and governing documents were revised to reflect current state law and to keep the city from being a component unit of the district, and recommended approval. Applicant John Gust said Tingey's presentation covered the item. No one spoke at the hearing. The minutes record no dollar amounts, bond issuance or reimbursement.

Assistant City Manager Don Tingey said the city adopted an impact fee for the area several years earlier, that a consultant updated the water fee study using the known costs of a new water tank and transmission lines, and that the amendment increases the fee by approximately $156 per equivalent residential connection. No one spoke at the public hearing. The minutes do not state the resulting fee or an effective date.

Resolution R2026-21: second amendment to Kunkler Trust property development agreement

    Approved · 5-0

The council approved a resolution authorizing the mayor to sign the Second Amendment to the Development Agreement for the development of the Kunkler Trust property by The Boyer Company, LC. City Attorney Ryan Loose described the agreement as allowing the city to buy about five acres for a senior center and about 200 affordable senior housing units in partnership with Ivory Innovations, and as permitting the developer to build up to 500 residential units, about 265 of them transferred from existing entitlements and 235 additional. Council Member Kathie Johnson said the authorization would not obligate the developer to build all 500 units. No one spoke at the public hearing. The vote authorizes the mayor to sign; the minutes do not record that the amendment was signed or that any housing was built.
